The TAR rejected the appeal of the Sciacca prosecutor, Roberta Buzzolani, and confirmed Giovanni Di Leo as head of the Agrigento prosecutor’s office. Buzzolani has more titles than Di Leo, however the CSM, the Superior Council of the Judiciary, considered – and the TAR agreed – Di Leo’s varied previous activity as prevalent. In fact, the TAR writes: “The CSM considered that the nominee Di Leo has experience both in the civil sector and (mainly) in the criminal sector, having carried out judging and prosecuting functions in first instance offices and at the Supreme Court of Cassation”. And then, referring to Buzzolani’s qualifications, the TAR adds: “The mere possession of a single specific indicator does not imply an automatic prevalence over the other candidates because the CSM is free to carry out a more overall and unitary assessment of the candidates’ professional profile with the aim of identifying the best manager in relation to the specific position put up for competition”.
