PALERMO – Resuttana boss Nino Madonia must remain at 41 bis. The appeal to the Supreme Court of the defense of the septuagenarian mafia boss from Palermo who has collected a string of life sentences has been rejected. The last one for the double murder of agent Nino Agostino and his wife Ida Castelluccio.

A conviction, which came after years of investigations and misdirections, for which Vicenzo Agostino, who died a few days ago, fought until his last breath.

The boss claimed that the long detention had caused his operations to cease. First the Supervisory Court and now the supreme judges had an opposite opinion. The Madonia family remains strong in the area through the role of the mafia boss’s relatives.

A long trail of death

Nino Madonia, son of Don Ciccio, has signed a long trail of death and horror: from the murder of the secretary of the communist party Pio La Torre to that of the general Alberto dalla Chiesa; from the massacre in via Giuseppe Pipitone Federico, in which the judge died Rocco Chinnici to the assassination of the deputy commissioner Ninni Cassarà and the agent Roberto Antioch:

And again: from the Pizzolungo massacre, which aimed at judge Carlo Palermo, who remained unharmed, but which cost the life of Barbara Rizzo and to his children, the twins Giuseppe and Salvatore Asta aged 6, to the double murder Agostino-Castelluccio.

What the Supreme Court says

The Supreme Court underlines “the current vitality of the associative structure in which Madonia had long played as well as its consolidated family component (until 2021, dozens of affiliates, some related to Madonia, operating in the Resuttana district, were arrested during numerous police operations).

And again: “The absence in his inframural conduct of elements somehow symptomatic of his distancing from the criminal organisation; on the contrary they result repeated sanctions for disciplinary infractions”.

The defense’s attempt to raise doubts about the constitutional legitimacy of law 199/2022 did not pass denies the possibility of recognizing any prison benefits or rewards to prisoners under 41 bis (who are the Sicilians under the hard prison regime).
