COSENZA – “The municipality of Cosenza has a debt of Euro 2,275,688.00 with the Valle Crati Consortium and since the installation of the new Mayor Franz Caruso, the dues for an amount of Euro 423,620.00 have never been paid. The president of the Valle Crati Consortium declared this in a note Maximiliano Granata.
“One of the striking cases of bad payers is the municipality of Carolei who has not paid the membership fees for 15 years despite repeated warnings, and has been put in default and is indebted to the Valle Crati Consortium for an amount of Euro 169,683.39. Given the above, it follows that if they do not pay their dues, the President, to restore legality and avoid further failures, see Valle Crati SPA and Amaco Spa, with resolution no. 1 of 02/07/2024 has the voting rights of defaulting municipalities have been suspended at the meeting and consequently not allowing them to participate in the decisions of the members for the time of the arrears (in accordance with Cass civi. Sez,I, nr. 1185 of 01.21.2020.
What’s more – continues Granata – last 03/27/2024 the consortium board of directors, precisely by virtue of the important and continuing arrears of the consortium municipalities which effectively prevents the valid convening of the members’ meeting and, at the same time, does not allow to complete the statutory obligations attributable to the assembly body, was forced to initiate towards a first group of consortium municipalities (Carolei, Cosenza, Montalto Uffugo) the collection of consortium fees through the proposition of executive and ritual judicial procedures. We inform you that on 04/22/2024, the Court of Cosenza issued the injunction, promoted by the lawyer. Oreste Morcavallo on behalf of the Valle Crati Consortium, judge Dr. Marzia Maffei, for an amount of Euro 317,715.00. The Municipality of Cosenza has to pay over two million Euros and we cannot allow it to benefit from essential public services without paying and therefore spread its debts over the other municipalities. This was declared by the President of the Valle Crati Consortium, Avv. Maximiliano Granata”.
