The way it was told it seemed like a classic case of master and domineering comradebut it emerged in the courtroom a whole other story.

So Wednesday 24 April the Court of Tivoli acquitted a 68-year-old Italian because the fact does not subsist from the accusation of mistreatment in the family against his ex-partner and the woman’s 4 children.

According to the reconstruction of Tivoli Prosecutor’s Officethe events happened in Zagarolo from 2017 until April 25, 2020a period in which the 68-year-old Italian lived with his 20-year-old younger partner and her children from a previous marriage.

A difficult relationship theirs, from which a child was born who was two and a half years old at the time of the events and who, according to the alleged victim, was unfortunately also a witness to mistreatment that occurred within the domestic unit.

The woman, originally from Northern Italy, had thus denounced her partner for the crime of mistreatment against family members and cohabitants.

The prosecution in the courtroom claimed continuous episodes of physical violence against the woman and her four children intimidation, humiliations, insults And threats. The ex felt denigrated, overwhelmed And scared from his partner to the point of continually trying fear for his own safety and that of his children.

The companion, again according to the victim’s story, the he threatened to “kick” her out of the house thus depriving her of decision-making and economic autonomy and generating in her a condition of complete psychological subjection.

For this Wednesday the Power of attorney asked the Judicial Panel for a sentence of three years’ imprisonment.

Facts and arguments completely refuted by the defense in the capacity ofLawyer Eleonora De Santis. “Absolutely no type of physical violence, threat, insult or humiliation was committed by my client”.

“The man had a salary of 1500 euros and anyone knows very well that being able to support a family of seven nowadays is almost impossible”Lawyer De Santis further explained.

Simple requeststhose made by man, of “economize” and avoid unnecessary waste of money to maintain the economic stability of the family, according to the defense theory. With respect to the accusation of having forced his partner to leave her job as a cleaner in a hotel, the defense stated that the choice had been absolutely voluntary and strictly linked to the possibility of fully assisting their very young daughter, who certainly needed of continuous care and attention.

Precisely on these statements, the Board chaired by the Judge Sergio Umbriano – to the side the Judge Matteo Petrolati and the Judge Francesca Fabbrini – decided differently compared to the accused’s position, ruling full sentence of acquittal and indicating in the dispositive case the non-existence of the fact claimed by the prosecution.

For the reasons for the sentence we will have to wait for the filing in 60 days.
