The referendum campaign that the CGIL introduced through four questions for reduce precariousness and guarantee greater safety in procurement. Proposals that the regional secretary Massimo Bussandri and the provincial secretary Ivo Bussacchini they presented on Wednesday 24 April in an assembly, organized at the Chamber of Labor of Piacenza, to the delegates of the local workplaces.

Referendums for which the union is preparing to collect the 500 thousand signatures needed by the summer to then go to the vote next spring. The goal is to collect over 10 thousand in Piacenza and its province. The appointment for the first provincial initiative in Piacenza to collect signatures is in Piazza Cavalli, after the official speeches on the morning of the Liberation Day, with a banquet that will be set up in the main square of the Emilian city. In the same places of Piacenza Collettiva, a week of celebration and people organized by CGIL, Arci and Anpi, signatures will be collected for the four referendums on dismissals, fixed-term contracts and safety.

“There are four referendums – explained the general secretary Bussandri – which have three themes at the centre: layoffs, precariousness and tenders. Through these referendums we want to propose a discussion on the development model in our country: today’s model, in fact, is profoundly wrong, given that it is based on too much precariousness, too many contracts and excessive attention to profit margins, to the detriment of wages and of the quality of the work. Furthermore, the tragedies of recent months also signal very little attention to the health, safety and lives of workers.
Even in Emilia Romagna – continued Bussandri – we are unfortunately not immune to this production model: in these first months of the year there has been a constantly increasing layoff, both ordinary and extraordinary. Just as accidents and deaths at work are increasing, despite – as mentioned – production volumes being decreasing. The four questions we propose precisely go against this model. We leave on April 25th precisely because the dignity and freedom of work are themes that have been handed down to us by our Constitution, conquered by the Resistance. In Emilia Romagna we aim to collect 236 thousand signatures on each referendum question.”

Here are the proposals put forward by the CGIL “to reduce precariousness and guarantee greater safety in procurement”.

the first question: right to reinstatement

The first question aims to cancel the entire legislative decree 23 of 2015, the famous “Jobs Act”, a law which has effectively made article 18 of the Workers’ Statute inapplicable in 90 percent of cases: a company with more of 15 employees can dismiss illegitimately, therefore even if there is no just cause or justified subjective or objective reason (company restructuring, company crisis, job suppression, etc.) and the worker cannot be reinstated: he has the right only to a compensation that is established exclusively on the basis of years of service in the company (an element also declared unconstitutional by the Council).

the second question: protections against dismissals

The second question concerns companies with fewer than 15 employees. If a worker is fired, goes to the judge and proves that his dismissal was illegitimate, the law provides for reinstatement or compensation. The CGIL referendum calls for the repeal of the rule that places a maximum ceiling on compensation which is 6 months, which can be increased by the judge up to 10 months.

the third question: overcoming precariousness

The third question concerns the fixed-term contract and wants to intervene on the rules that have liberalized its use, in the private as well as in the public sector.

the fifth question: safer work in procurement

For the fourth question we are in the field of procurement and in particular security in procurement. Today, if a company contracts out an activity to another and this to yet another, the clients are not jointly liable in the event of an accident or professional illness of the worker. The question seeks to cancel the rule that excludes this responsibility.
