PAVIA. Three and a half years for having made her sister’s life hell, to which she will have to pay 50 thousand euros in damages as an advance on compensation. And the electronic bracelet as a protection measure for the victim, who will however have to wear the device like her stalker, so that she can receive a signal in the event of an approach within 800 metres. Judge Daniela Garlaschelli yesterday morning sentenced GZ, the 61-year-old doctor (no longer in service for some time) who on the morning of 25 July 2023 fired a gunshot in via Bonetta, in the Porta Calcinara area, with a gun taken out of home without authorization. A gunshot that pushed the prosecutor’s office to investigate further and which revealed, from the prosecution’s point of view, a picture of persecution against the sister, which had lasted for years.
The man was convicted but is free (his house arrest had already been revoked), although he is forbidden to approach his sister and must remain at a distance of at least 800 metres. To enforce the provision, the court decided to apply the electronic bracelet to him but also to his sister. It is the first case, in the province of Pavia, in which this protection device is used on a victim of stalking.
What accusations
The man, defended by lawyers Daniele Cei and Davide Steccanella, was convicted of persecutory acts and illegal possession of a weapon but acquitted of the charge of attempted murder, as also requested by the prosecutor’s office, for having lurked under his sister’s house with the gun load.
According to the reconstruction of the prosecutor Andrea Zanoncelli, the sister and other family members of the suspect (the personal details are omitted only to protect the victims of the crime) had been receiving threats for some time. A situation that degenerated after the death of the accused’s father, who had also supported him financially for years.
The night before the shooting in the street, the suspect had called his sister several times on the phone and, unable to contact her, he had sent messages to his brother-in-law at dawn, with death threats. Then he went to his sister’s house, lurking for about an hour, as recorded by the building’s cameras.
He then returned to his house and in Via Bonetta, getting out of the car, he fired a gunshot (a Tanfoglio 9X21 caliber with the permit to keep it having long since expired). He barricaded himself in the house and was then arrested.
The bracelet
The suspect, after hospitalization in psychiatry at San Matteo, was placed under house arrest in a community in Lecco. After the revocation of the measure, the judge first applied and then revoked the electronic bracelet. But the protection measure has been restored, with an important modification: the bracelet, in fact, will also be applied to the victim, who should receive an alarm if her brother comes within 800 meters of her. The woman gave consent several weeks ago but her electronic bracelet has not yet been applied to her.

«We are satisfied with the conviction for stalking, even with a higher sentence than the public prosecutor’s request – declares the woman’s lawyer, Luigi Fornari -. On the attempted murder, however, I struggle to understand the acquittal, even if with a doubtful formula: in the video surveillance images you can clearly see the accused with a (loaded) gun in his pocket inside the building where my client lives. We will read the reasons but now the important thing is that the victim protections decided by the Gup are finally implemented”.

«With all the precautionary, security and prevention measures that the law makes available, the magistrates have chosen to condemn me, the victim, to wear a shameful and conspicuous prison bracelet, which will prevent me from any privacy and will remind me every moment of the badly received and the danger I run”. This is the outburst of the sister of the defendant sentenced yesterday morning in court against the decision to apply the electronic bracelet to her too. «Instead, they left my persecutor brother free, despite having ascertained the facts committed and documented his mental disorders, to harm himself and others, without having, unlike me, to communicate where he is, where he lives and if he treatment. In any case, today, one month after the release, I don’t have any protection bracelet and neither does he have any control bracelet – adds the woman -. So I could find him at my house tonight amidst general indifference. Nobody responded to the family’s desperate calls for help.” The woman has long been asking for institutional intervention to take care of her brother as a psychiatric patient. In a letter sent to the CPS, the ATS, the Psychiatry Operational Unit, the mayor of the Municipality of Pavia and the Social Services, you ask for admission to a treatment facility. In her request for help, the victim makes a comparison with the story of Alice Scagni, killed in Genoa by her brother.
