El Mostafa Halloumi goes under house arrest. The investigating judge Michela Valente accepted the request presented by the lawyers Alfredo Collivignarelli and Pompeo Del Re, legal defenders of the suspect arrested in March following the operation of the Guardia di Finanza, in Cerignola, which discovered an alleged social security fraud through agricultural companies phantom and a system of easy passes for non-EU citizens.
The lawyer Collivignarelli declares that he accepted this assignment because, after having carefully read the documents, he would have found that he was completely unrelated to the facts for which El Mostafa Halloumi was investigated, while still considering his position to be strictly marginal and not prominent.
In the request for revocation of precautionary measure, the lawyers highlighted in the introduction that the suspect responded to all the magistrate’s questions by providing further clarifications, answering the prosecutor’s questions, “which underline the absence of the prerequisites and conditions, especially the lack of precautionary needs, to maintain the measure of precautionary custody in prison” they explain.
During the investigation he provided further elements in order to clarify his position, demonstrating availability and a spirit of collaboration with the investigating authorities. In the revocation request, the lawyers pointed out that El Mostafa Halloumi has been resident in Italy for over twenty years, has always had a clean criminal record, and has been dedicated to work.
“Since 2019 he has undertaken commercial butchery activities through his own sole proprietorship, and is perfectly integrated into the social fabric, so much so that he is involved in voluntary and philanthropic activities, as can also be seen from local press publications. In particular, El Mostafa Halloumi is one of the representatives premises of the Moroccan community in Vasto and has always been a point of reference in relations with the public authorities from which he has also received praise for the meritorious works carried out”.
According to what we read in the papers of the investigating judge, the suspect would have favored the illegal entry of his compatriots by helping Alessandro Ardone (who had made use of the mediation of Giuseppe Defeudis), to obtain the availability for the fictitious hiring by Antonio Bellonio against of some subjects, upon remuneration of sums of money.
