TREVISO – The Court of Cassation he fails Speed ​​Cameras from the Ring road. AND Ca’ Sugana runs the serious risk of having all the fines issued for speeding canceled: a terrible blow for the budget considering that, in 2023, the collection was more than 5 million euros. According to the Court, the electronic tools used by the Municipality, and by all municipalities in Italy for some time, do not have adequate approval from the Ministry but only a generic authorization. An issue that emerged with the appeal made by a professional Treviso fined because he was caught racing 97 kilometers hours when the limit on the ring road is 90. Already in the first instance the judge had agreed with him and rejected the fine. The Municipality then appealed to the Supreme Court, which however confirmed the rejection, creating a significant precedent. Now all judges who deem fines issued with that type of speed camera to be invalid will have a very valid point of support.

The fears

The sentence had an explosive effect on Ca’ Sugana. «We are worried – confirms the mayor Mario Conte – we are in contact with Ministry of Infrastructure to understand if it is possible to find a meeting point between the legislation and the need to guarantee safety on the roads as well as defend the budgets of the municipalities”. And then the doubt: keep the speed cameras on on the ring road or turn them off until there is further clarification? The mayor was almost resigned to having to block everything to avoid a barrage of appeals. But, at the end of a round of consultations between the legal office and the local police command, the position changed. And the administration has decided to carry on: «Having taken note of the order of the Supreme Court of Cassation – it is the official position – without prejudice to a greater in-depth study of the reasons and consequences of the aforementioned provision also with the company that supplies the equipment, it is considered appropriate to keep the speed detection systems operational considering that the deadlines for the possible notification of sanctions may expire following the issuing of further jurisprudential rulings or desirable legislative or regulatory provisions”. Translated: you don’t change.

«It is a sentence that worries us greatly – reiterates Conte – which prevents us from guaranteeing road safety and limiting speed in those arteries considered most at risk. A sentence which, however, must be analyzed in depth and which we will do in the next few hours, also overlapping it with the new one Traffic Laws. Then we are ready to ask for a discussion with the Ministry of Infrastructure to understand how we can act to guarantee the municipalities that have already issued a budget estimate.”
