Assisted suicide, the government appeals to the TAR against the Emilia-Romagna resolutions

The government has lodged an appeal with the TAR against the Emilia-Romagna resolutions desired by Stefano Bonaccini to regulate the procedure for assisted suicide. This was announced by Forza Italia regional councilor Valentina Castaldini, who in March filed an initial appeal together with a group of associations. The Presidency of the Council of Ministers and the Ministry of Health opposed the Region’s measures, with a request presented to the administrative court on 12 April. Castaldini highlights “the body’s lack of power” on the matter “and the contradictory and illogical nature of the reasons introduced in the guidelines sent to the healthcare companies”. The council’s provisions introduced a process and timescales for access to medically assisted suicide, with the intention of filling the legislative gap and putting healthcare companies in a position to guarantee the right of patients sanctioned by the ruling of the Constitutional Court (n. 242/2019). The resolutions introduce a maximum of 42 days for bodies and institutions to respond to the patient’s request for end-of-life execution. Among the contested elements is also the establishment of Corec, the Regional Committee for Clinical Ethics, which is called upon to express a non-binding opinion on patient requests.
