From the back cover of the book: Over the last thirty years, crime in Italy has collapsed: murders, which in 1991 were 1,938, are now just over 300 and other crimes have also largely decreased. However, the prison population has almost doubled and the number of life sentences has more than quadrupled, going from 408 in 1992 to the current 1,867. Penal policy has also changed radically. Even in the 1990s, the majority of Italian parliamentarians were in favor of the abolition of life imprisonment, voted by the Senate on 30 April 1998 by a very large majority. Today all the forces present in Parliament reject, as a defamatory accusation, the idea of ​​being in favor of the abolition, not let’s say of life imprisonment, but even of the hard prison of life imprisonment. These extraordinary changes cannot be explained except as the effects of the reduction of guarantees of due process such as limits to punitive arbitrariness and the decline of the culture of guarantees both in the political class and in the judicial class. Against this regression, this book proposes the classic model of criminal jurisdiction as the assessment of legally predisposed crimes, on which its democratic legitimation is based. It proposes the strengthening of criminal and procedural guarantees suitable for implementing this model.
