According to Legislative Decree 25/2008, «a State not belonging to the European Union can be considered a safe country of origin if, on the basis of its legal system, the application of the law within a democratic system and the general political situation, it can be demonstrated that, in a general and constant way, there are no acts of persecution, torture or other forms of inhuman or degrading punishment or treatment, nor danger due to indiscriminate violence in situations of internal or international armed conflict. The designation of a safe country of origin can be made with the exception of parts of the territory or categories of people.” The citizen of a country considered safe can still request and obtain international protection in Italy.
