JESOLO (VENICE) – Request for suspension rejected. Battle for beach concessions: the second round also goes to the Municipality. It is the decision taken by the president of Tar Veneto Leonardo Pasanisi, who yesterday morning, after two days of skyrocketing anticipation, signed the ordinance rejecting the request for the early occupancy permit issued last 23 April by the Municipality’s State Property office to CBC srl. This is the consortium represented by the Mario Poletti Polegato family, the Menazza hoteliers and the entrepreneur Alessandro Berton, who were awarded, through Regional Law number 33, the twenty-year management of the beach in the Umg5, i.e. in the stretch between Piazza Brescia and Piazza Mazzini. The outgoing concessionaires represented by the Consorzio Stabilimenti Centrali Scarl were against the award, the same ones who triggered the battle with stamped papers contesting the assignment and the evaluation criteria of the projects in competition. But already last May the Regional Administrative Court had rejected their first request, the one linked to the urgent suspension of the awarding of the concession. Yesterday the rejection of the suspension proposal relating to the advance employment granted by the Municipality to CBC srl. In addition to reiterating the reasons contained in the previous monocratic decree, yesterday’s provision specified that “given the expiry of the previous concession titles, no legitimate expectations can be recognized for the outgoing concessionaires”. Furthermore, the hearing for November 6th has been confirmed, when there will be a discussion on the merits of the appeal.

For the moment, however, the management of the beach will continue to remain the responsibility of the new managers. Faced with the TAR’s decision, the president of Scarl Renato Martin met his board of directors last night: «The order confirmed the need to delve deeper into the discussion of the merits of the objections raised in court, say the board of directors -. The correctness of our decision to want to move forward with the judgment to ask the TAR for a complete and in-depth verification of the tender is confirmed. Finally, as regards the critical issues in the current management of the beach, the TAR considered that they are not such as to allow the Consortium to take over the management attributed to the CBC at this time. On this point, we have some doubts, given the current situation on the beach. We will therefore evaluate, regarding this specific point, the adoption of new judicial initiatives.”

«ENOUGH CONTROVERSY»

Having received the favorable opinion of the TAR, the mayor Christofer De Zotti launched an appeal for common sense: «We welcome with satisfaction the opinion expressed by the TAR – his words – which confirms the good work of the Municipality and reiterates that the priority is to ensure a service on the beach. This is what primarily interests the Administration. Against this same interest, which is specific to the operators but also collective, are those who transform partisan interests into a political tussle without worrying in the slightest whether this could damage the city and without worrying about holding institutional positions, fanning the flames of protest rather than reporting in the context of civil discussion those who – with full rights – express dissent and make criticisms. The invitation is therefore to both parties to make the logic of dialogue and the protection of everyone’s interests prevail.”
