Local health authority employee affected by bronchial asthma wins appeal

The bronchial asthma diagnosed by an employee of the Caserta Local Health Authority is due to the work carried out on behalf of the health company. This was recognized by the technical consultant appointed by the labor judge of the Court of Santa Maria Capua Vetere in the appeal presented by the worker, FG, against INAIL which had rejected the request for recognition of an occupational disease made by the man.

The man worked at the Piedimonte Matese hospital as a blacksmith, responsible for repairing medicine transport trolleys and oxygen cylinders as well as installing pipes and sheets. Since he was exposed, due to work, to adverse micro-climatic factors and to chemical agents deriving from fire welding, he proposed, with the advice and assistance of the Inas Cisl Patronage of Caserta, the application for recognition of an occupational disease of bronchial asthma but INAIL had rejected the request.

The man, assisted by the lawyer Domenico Carozza, turned to the Labor Court to obtain judicial recognition of the occupational disease. The office technical consultant (CTU), unlike INAIL, recognized that the pathology reported by the worker is of professional origin because it is to be attributed to the methods of carrying out the work activity, attributing a significant percentage of biological damage to the appellant.
