Published in the Official Journal of the EU Series L of 22 May 2024 Commission Delegated Regulation (EU) 2024/1399 of 10 November 2023 relating to classification conditions, without testing, of solid wood coverings and panels in relation to reaction to fire and amending Decision 2006/213/EC.

With Delegated Regulation (EU) 2016/364 of the European Commission, a system of classification of the performance of construction products in relation to reaction to fire was adopted. Solid wood panels and cladding are among the construction products to which this delegated regulation applies.

The classes of (performance in relation to) reaction to fire for solid wood panels and cladding are established in the annex, table 2, of Decision 2006/213/EC of the EU Commission. The conditions set out in the above Decision for such products need to be clarified so as to explicitly limit their application to untreated wood only.

Tests have shown that solid wood panels and cladding have stable and predictable performance in relation to reaction to fire, provided they meet certain conditions relating to the minimum average density of the wood, the minimum profile thickness and the end use of the product and that the wood is not subjected to any treatment other than kiln drying.

New regulation in force in 90 days

It is therefore appropriate to consider solid wood panels and cladding to comply with a certain performance class in relation to reaction to fire referred to in Delegated Regulation (EU) 2016/364 under all these conditions, without further testing being necessary.

For the purposes of legal certainty, Delegated Regulation (EU) 2024/1399 deletes Table 2 of the annex to Decision 2006/213/EC and replaces it with an annex for solid wood panels and cladding.

In order to give manufacturers, in particular small and micro-enterprises, sufficient time to evaluate the effect of the new Regulation on their activities, the entry into force of Delegated Regulation (EU) 2024/1399 is ninety days after the publication in OJEU.
