PALERMO – The labor judge of Palermo, with a ruling last April, accepted an appeal presented by an employee of Amat (public transport company), assisted by a lawyer Nadia Spallittawho had been fired because after his hiring, and after the six-month probationary period, it was ascertained that he lacked a high school diploma, a requirement set out in the competition notice in which the appellant had participated.
Amat, the judge’s decision
The judge confirmed the substantial illegitimacy of the clauses of the competition notices, also of investee companies, which provide under penalty of exclusion non-essential requirements for access to that type of qualification. In particular, since a high school diploma is not an essential requirement for access to the role of driver (operator), the judge ordered his reinstatement to his job and condemned the company to the payment of wages accrued during the period of dismissal and legal expenses.
