Uncultivated vegetation, the Municipality of Manfredonia orders private individuals to mow it to avoid fires and the proliferation of insects

Having seen the Law of 21 November 2000, n.353 “Framework law on forest fires”;
Having seen the art. 255 of Legislative Decree 3 April 2006 n.152 “environmental regulations”;
Having seen the articles. 7 bis and 50 of Legislative Decree 267/2000 (Consolidated Law on Local Authorities);
Having seen Law 689/81 and subsequent amendments, introduced by art. 6 bis of Legislative Decree 23 May 2008 n. ninety two,
conv. In law 24 July 2008, n. 125;
Having said all this, for the reasons given,

ORDER

for needs of environmental protection, fire prevention and protection of hygiene and public health,
that: all owners and/or holders in any capacity of uncultivated, abandoned open areas (areas
artisanal, industrial, abandoned, open construction sites, condominium-gardens and/or green areas in general), located in the town center and in the municipal area, immediately ensure the mowing and uprooting of the grasses and the cleaning of the brushwood and mowing residues in all private areas and, especially,
in those bordering public areas (roads, etc.), as well as the restoration of optimal hygiene and health conditions of the same, also having regard to the disposal of waste materials collected at an authorized site;

All the subjects indicated above shall take action, starting from the date of publication of this ordinance
until 30 October 2024, to maintain the aforementioned areas in such conditions as to prevent both the
proliferation of weeds, brushwood and other forms of spontaneous vegetation, as well as the proliferation of
dangerous animals (mice, reptiles, insects, ticks, etc.), as well as the release of waste of any kind;
In the period between the start date of publication of this ordinance and 30 October 2024, it is prohibited, in or near agricultural land, wooded or bushy areas,
as well as along the roads and, in general, in all the other areas indicated above, to light fires, use
open flame or electric appliances that produce sparks, carry out any other operation that can generate open flame;
This ordinance comes into force from its publication on the Notice Board and will last until 30 October 2024, considered a suitable deadline for the execution of the aforementioned activities.
WARN
That in the event of non-compliance, unless the fact constitutes a more serious administrative offense or crime, a pecuniary administrative sanction of Euro will be applied to violators of this ordinance.
150.00 (one hundred and fifty/00) to Euro 500.00 (five hundred/00).
Violators are eligible to pay a reduced amount, pursuant to art. 16 of Law no. 689/1981, to be carried out within 60 (sixty) days from the immediate notification of the violation or from the notification of the violation assessment report.

PROVIDES THAT
The local police and law enforcement agencies, each within their own sphere of competence, shall take action
comply with this ordinance to protect public safety and to protect public greenery.

IT ALSO HAS
that this ordinance is published on the Notice Board and on the Institution’s institutional website
(www.comune.manfredonia.fg.it.) and is carried out immediately;
that this Ordinance be sent to the Prefecture – Territorial Office of the Government of Foggia,
Municipal Police Command, the PS Commissariat, the Carabinieri Command, the Reclamation Consortium of the Captaincy of Foggia, the Guardia di Finanza Command, the State Forestry Corps of Foggia, the Provincial Fire Brigade Command and the ASL FG, in charge of ‘observance.
