The “It’s always April 25th” group, a chat hosted by the Repubblica journalist Massimo Giannini, launches yet another appeal to save democracy, which, this time, would see its quality weakened by the absence of the fifteenth member of the Constitutional Court, nominated by parliament, on whose name an agreement has not been reached that would guarantee him two thirds of the votes of the assembly. In truth, it is a stalemate situation that occurs quite often: the most striking case was the absence of three constitutional judges in 2015, which, also due to the precarious health conditions of another member, who resigned shortly after, risked making decisions impossible, which require the presence of a minimum of 11 members. Gerardo Colombo also intervened, but he limited himself to asking that Parliament be convened “as soon as possible”.

Giannini, however, attributes the delay to Giorgia Meloni’s “pretention” to intervene on the issue, as if it were an undue invasion of the pitch. In truth, when it comes to making parliamentary decisions, all party leaders obviously try to make their voices heard, and Meloni is leader of the relative majority group in the assembly, so all he does is behave like everyone else. The need to call meetings where, in the absence of an agreement, nothing is achieved is rather questionable. There have been cases in which 36 empty votes were needed before an agreement was reached. Whether or not this benefits the credibility of democracy is quite clear. On the other hand, it is precisely the Constitution that dictates a mechanism that makes the appointment of members which is the responsibility of Parliament very complex, but it has always been like this, there is no democratic emergency, just an institutional bottleneck that presents itself once again.

On the other hand, the very fact that 11 members out of 15 are sufficient to make the decisions taken valid is proof of the awareness that reaching the plenum is more an exception than the rule. Naturally, a more relaxed climate in relations between the majority and the opposition would help overcome institutional bottlenecks, but if you frame this relationship as a struggle between fascists and anti-fascists, naturally the climate remains poisoned.
