SAN MICHELE SALENTINO – The dismissal has arrived for seven people and two companies for the death of the worker who lost his life during the construction of a dealership in San Michele Salentino. The investigating judge of the Court of Brindisi, Vilma Gilli, has ordered the dismissal of the investigations against seven people and two companies involved in a branch of the investigation into the death of Franco Mastrovito, the 49-year-old from Ostuni overwhelmed by the collapse of an attic during the works of construction of a new warehouse for a car dealership in San Michele Salentino.
Among the positions archived, at the request of the same prosecutor’s office, are those of the owner of the dealership Andrea Turrisi and of Prefabbricati Pugliesi, the company that had supplied the prefabricated structures for the construction of the warehouse.
In his dismissal decree, the investigating judge does not recognize any fault in the client of the work, having limited himself to choosing the companies apparently suitable to carry out the work. Nor have any responsibilities been identified in the three workers who were responsible for transporting and unloading the concrete on the construction site. Charges also dismissed for the technical manager and production manager of Prefabbricati Pugliesi who had dealt exclusively with sending the concrete samples to be used for the works and with the supply of materials.
As regards Prefabbricati Pugliesi and Colabenton (concrete supplier), the judge notes that neither have any liability profiles as no anomalies were found in the investments in workers’ health and safety and in the adoption of organizational and management models.
In the dismissal order, investigating judge Gilli notes that the causes of the fatal accident are linked to the phases of casting the reinforced concrete and the absence of suitable protection measures and not to possible defects in the material used, the suitability of which has never been questioned. in discussion.
Four defendants remain in the legal proceedings: Domenico Padula, Stefano Barletta and Giuseppe Mazzotta and the entrepreneur Massimo Ferrarese, sole director of Prefabbricati Pugliese, who is accused of not having gone in person to verify the presence of a “collar” of connection between a pillar and the underlying plinth. Collarino which was not, as noted by the prosecutor’s office itself, the responsibility of Prefabbricati and which was created by another company. But according to the accusation, Ferrarese should have checked in person despite the fact that in each of the construction sites scattered across Puglia (with 200 employees) he has a technician delegated to carry out every form of control to protect the quality of the work and the safety of those who work.
