Following the investigative activity coordinated by the Public Prosecutor’s Office of Benevento, the Officers and Agents of the Carabinieri Station executed the order for the application of the precautionary measure of removal from the family home with a ban on approaching the offended person and the places habitually frequented by the same, with the obligation to maintain a distance of 500 meters from the aforementioned places and from the offended person with the electronic bracelet control method, issued by the GIP of the Court of Benevento, at the request of the Public Prosecutor’s Office of Benevento, against of a 37-year-old living in Moiano and seriously suspected of crimes of family abuse and aggravated injuries against his spouse.
“The investigations – underlines the prosecutor Aldo Policastro – were started following the complaint of the offended person: the same, following yet another domestic dispute and a final attack, after having gone to the local hospital, on the occasion reported the degree of psychological pressure that she had been suffering for years due to the conduct of her husband who adopted increasingly oppressive, aggressive and intimidating behavior towards her.
The man’s conduct, in this case, now occurred on a daily basis and took the form of frequent episodes of physical aggression even in front of his minor children as well as continuous interference in every area of the daily life of his spouse, who was unable to independently carry out work and was subjected to to the constant and pressing control of the spouse. Furthermore, according to what emerged, the man had also recently physically attacked his wife with punches and slaps during a trivial argument, leading to the young woman’s decision to immediately leave the house and report the facts.
The investigative activity, therefore, which was mainly articulated in the acquisition of the declarations of the offended persons as well as other family members aware of the facts and the neighbors of the family unit with the carrying out of judicial police investigations in response, thus made it possible to quickly collect serious indications of a crime against the suspect, and the GIP at the Court of Benevento, accepting the request of the local Prosecutor’s Office, issued the application measure of the precautionary measure of removal from the family home with the prescriptions indicated against the suspect, I also believe the existence of precautionary needs and the danger of committing acts of the same kind. The measure carried out today is a precautionary measure ordered during preliminary investigations, against which appeals are permitted, and the recipient of the same is a person subjected to investigations and therefore presumed innocent until a final sentence is reached.”
