San Siro Stadium, appeal against the restriction on the second tier rejected

Nothing to do, the constraint is confirmed. The Regional Administrative Court of Lombardy rejected the appeal of the Municipality of Milan – declaring it inadmissible – against the Ministry of Culture and the Superintendency of Archaeology, Fine Arts and Landscape for the Metropolitan City of Milan: the Giuseppe Meazza stadium cannot therefore be demolished due to its value historic of the second ring built in the 1950s, close to exceeding the 70 years of age that are crucial for reaching the “age requirement”. There is therefore no hope that San Siro can be demolished to make room for a new stadium, the paths explored by the clubs will continue to be the others: from its renovation to the construction of other stadiums in Rozzano (Inter) or San Donato Milanese (Milan).

the motivations

“The appeal is inadmissible – we read -, partly due to lack of interest, where it contests the opinions expressed by the Superintendence and the Regional Secretariat, partly due to lack of jurisdiction, where it criticizes the configurability of an archive exposed due to the non-attributability of the assets involved in the municipal heritage. The two provisions reveal that the verification of cultural interest concerns properties dating back over seventy years, therefore any advance evaluation is not relevant for the purposes of establishing the declaration of cultural interest”. “Ultimately, the introductory appeal and the subsequent appeal for additional reasons are inadmissible, partly due to lack of interest and partly due to lack of jurisdiction”.
