Foggia, Gdf investigation on facilitated assignments of MSW collection

‘Facilitated’ assignments for the collection of solid urban waste in the Foggia area: hypothesis of tax damage for over 5 million in 54 municipalities of the Capitanata area. The Economic – Financial Police Unit of the Guardia di Finanza of Foggia examined the procedures for awarding the local public waste collection and disposal services of 54 local public bodies.

In this context, particular attention was paid to the contributions recognized and provided by the national Corepla supply chain consortium as part of the framework agreement for the recycling of plastic packaging. The analysis of the administrative acts issued for the assignment of the aforementioned services has made it possible to identify various hypotheses of fiscal damage quantified in total at 5,154,130 euros deriving from the failure to adopt “competitive” procedures in the assignment of the aforementioned services and from the failure to receive contributions from local authorities.

In fact, the analysis of the award procedures adopted revealed the constant direct award of the services in question through “contingent and urgent” extensions in place of “competitive” procedures for choosing the contractor or the use of “below threshold” assignments without guaranteeing the compliance with the principles of free competition, non-splitting of contracts and the obligation to rotate contractors. Furthermore, the assignment according to “in house” methods in the absence of demonstration of an economic advantage for the institution. At the conclusion of the investigations, 60 technical managers from the 54 municipalities inspected were reported to the Regional Prosecutor’s Office of the Court of Auditors at the Jurisdictional Section for Puglia.
