Castellammare – The TAR accepts the Chalet’s appeal, closure order annulled

The TAR cancels the demolition order of the Chalet Laura in Castellammare di Stabia. There is no evidence that the room where the kitchen was built is public property: the Regional Administrative Court of Campania thus canceled the demolition order for building works on public land notified to the company that owns Chalet Laura in April last year. Furthermore, any hypothesis of closure of the restaurant has been ruled out and it will be able to continue its activity. The legal battle thus ends in the first instance and brings relief to the company and its employees. The news appeared today in the Metropolis newspaper.

The story began with anti-illegal checks by the municipal police which took place on 13 March 2023 which revealed discrepancies

à in the Chalet Laura, in particular regarding the outdoor area and the kitchen. The Municipality’s provision provided for the demolition of building works built on public land, but the company contested the fact that the property was public or ecclesiastical property.

The Court underlined that there is no certain evidence regarding the public ownership of the land on which the kitchen was built, and therefore decided to cancel the demolition order and allow the place to continue its activity. The company had already remedied the other construction violations previously found, demonstrating its good faith.

This decision represents an important turning point for Chalet Laura and the owner company, which can now continue their business without obstacles.
