On the project to build the “Valdastico” motorway, the TAR agrees with the Province and rejects the appeals presented by the Municipalities of Trento and Rovereto.
It was the Provincial Council’s proposal for a Variation to the PUP regarding connections in the Eastern Corridor that was challenged. According to the judges, the Province did not harm the interests of the municipal administrations and indeed started the comparison process correctly, establishing a methodology and criteria for analyzing the topic.
“We respect the discussion and understand the reasons for a political-administrative dialectic that sometimes takes even decisive positions – commented President Maurizio Fugatti – but at the same time it is our duty to continue on a path that has been widely illustrated and included in the program of this as well as the previous legislature . However, the discussion will continue, as required by the regulations and with the full involvement of the parties during the discussion in the Chamber, once the bill reaches the Council”.
In detail, last December the Municipalities of Trento and Rovereto had challenged before the Regional Court of Administrative Justice the Provincial Council’s proposal for a Variation to the current Provincial Urban Plan relating to the Trentino East Corridor connection area.
The TRGA of Trento rejected the appeals of both Municipalities with sentences filed on 13 June 2020, maintaining that there is no concrete and current damage to the interests of the two appellant Administrations since the Provincial Administration did not act with the Variation in question no definitive choice regarding the methods of intermodal infrastructure connecting the Trentino territory with the Veneto, but has defined methodologies and criteria for analysis and comparison of the interests involved for the identification – through the participation of the territories in the context of approval of the urban planning instruments subordinated – infrastructure solutions that guarantee the satisfaction of connectivity needs while respecting the environmental protection of the territory.
The Variation, as clearly emerges from the acts adopted by the Provincial Council with a broad and detailed participation of the interested territories, integrated the methods of implementation of the PUP by specifying the methodology, purposes and procedures for “addressing and resolving the issue of connection with the Veneto, of the traffic volumes that affect Valsugana and of the connection needs that express in particular the territories of Vallarsa and the Cimbrian plateaus and to be able to prefigure, on the basis of the criteria and method established by the variant, in a new participatory and planning, also the best connecting infrastructure of Trentino towards the outside in the south-east direction”.
