CASERTA – The municipality managers involved in the investigation would have obtained advantages from the “favors” given to the entrepreneurs. The order notes that the manager Francesco Biondi and the surveyor Giuseppe Porfidia would have proceeded with an illegitimate assignment of works in favor of the Valle di Maddaloni entrepreneur Gioacchino Rivetti. The latter would have repaid himself by paying the liability insurance policy for Biondi’s vintage Mercedes and carrying out small works on properties in the municipality of Alvignano in the availability of Porfidia. According to the investigating judge, these favors “find no other justification than in the context of a corrupt agreement with the entrepreneur and consisting in the performance of acts contrary to official duties”. In October 2022, Rivetti asked Biondi for a copy of the registration certificate of his vintage car and contacted his trusted insurer ML (unrelated to the investigation) to find a suitable insurance policy, for a price of 290 euros. Biondi is responsible for abuse of office for having entrusted work at municipal schools in favor of the company “Green Aedilis srl”, formally administered by the brother (not investigated) of Raffaele Nunziante, but attributable to the latter.
The municipal manager Luigi Vitelli (under investigation at large) would instead have illegitimately entrusted the same company with tree felling work in Corso Trieste and safety measures in Via Galatina in San Clemente.
Biondi and Porfidia are also responsible for corruption: the former signed – in agreement with councilor Marzo – the decision to directly assign the works to the municipal dog shelter of Caserta, the latter drew up an accounting of the works carried out which did not correspond to reality. In exchange, Marzo would have received from Rivetti the consideration for the purchase of materials published by his company “Edil Marzo” for the execution of these works.
An assignment of works for various schools (Via Roma, Aldifreda, De Amicis, Lorenzini) also ended up under the scrutiny of the investigators and was apparently “unpacked” into three parts so as not to exceed the quota beyond which it is mandatory to resort to tenders and not assign the works directly. All in favor of Giuseppe Piscitelli’s company 2G Service srl. The latter would also have purchased material from Edil Marzo for over 30 thousand euros between 2022 and 2023 compared to no purchases for 2021.
Marzo would also have prepared, together with his staff worker Khachermi, the decision to assign the works of “Extraordinary maintenance and increase in street furniture located in the municipal area of Caserta” to the company “Gpm Service srls”, attributable to the Caserta entrepreneur Pasquale Marotta, thus violating the law that distinguishes the tasks of government from those of management in public administration. From this act it is not clear that the choice of the entrusted company was made in compliance with the rotation principle and also without adequate motivation. The same goes for the decision to assign maintenance work for primary schools, entrusted to the company “Ciemmedil srl”, managed by Michele Campanile. The latter would in turn have benefited Marzo with the employment of Gennaro Rondinone (in fulfillment of a promise made to the latter by Emiliano Casale during the electoral campaign) as a worker employed in painting the walls and installing plasterboard panels at the school buildings in via Rossini and at the “Don Milani” school in Caserta. Campanile also bought building materials from Marzo’s company.
In Rivetti, free municipal premises at the nursery school in via Cilea
CASERTA – The investigation documents include many intercepted telephone conversations between the entrepreneur Gioacchino Rivetti and the manager of the V Sector (Ecology and Environment) of the Municipality Giovanni Natale. Many of these conversations were followed by meetings to “have a coffee” at the bars near the Municipality or, frequently, at the Marino bar located via Cilea (in Centurano) near Natale’s home “and, not surprisingly , a few meters from the headquarters of Rivetti’s companies” note the investigators. The entrepreneur, in fact, used some rooms (former classrooms) located at the nursery school in via Cilea, given “free rental” by the Municipality of Caserta and used as the headquarters of the companies attributable to him. And in this regard it should be remembered that several councillors, both majority and opposition, have asked several times, without receiving satisfactory answers, for clarification on the use of municipal properties. In some conversations emerges Natale’s willingness to carry out inspections of a private nature at the building under construction in Rivetti, in the hamlet of Garzano, in via Pozzo or even indications during construction “to demonstrate – writes the investigating judge preliminary in the ordinance – of the close relationship that binds the entrepreneur” to the municipal manager.

CASERTA – The “favors” of entrepreneurs were sometimes also extended to municipal employees who, however, were not investigated. Among other things, painting work was carried out free of charge at the home of a municipal employee by a worker close to Gioacchino Rivetti. The entrepreneur is interested in the execution of these works, calling his friend to make sure of the execution. The availability and involvement of this worker (and his company) – writes the judge – was a direct consequence of Rivetti’s apparent exit from the scene “for his so-called reasons of expediency linked to the permanent employment of his son ( not investigated, ed.) at the Municipality of Caserta, among other things in the same sector directed by Giovanni Natale”. Councilor Marzo and manager Natale “influenced the choice of the beneficiary of direct assignments in order to remunerate the undisputed availability” of the entrepreneur in question.
It should also be noted that in the investigation documents there is the direct assignment of the works (then effectively subcontracted, in violation of the contract, to the entrepreneur DN, against whom proceedings are being carried out separately), for the extraordinary maintenance of the greenery of the schools municipal. There are therefore other lines of investigation open and developments could soon arrive on these episodes as well.
