An application for destruction of the forensic copy carried out by the Carabinieri of the Investigative Unit on the mobile phone of DM, the 26 year old investigated in the investigation of public competitions announced by the municipality of Avellino. The lawyer introduced her Gaetano Aufieroafter having obtained the annulment of the seizure from the judges of the Court of Cassation in recent days.
The defense of the suspect DM – candidate for a traffic policeman’s position in Avellino, blocked last January 11th before the oral test by the soldiers of the PEF Nucleus of the Fiamme Gialle of Avellino – obtained the annulment without postponement to a new evaluation of the Review. A result which in fact could also have effects on the documents that ended up in the investigation’s maxi-file “Sweet life”.
The reconstruction
The magistrates of the Review Court for real measures, in a different composition compared to the previous hearing (for which the annulment was triggered), i.e. the panel chaired by judge Gianpiero Scarlato and composed of magistrates Pierpaolo Calabrese and Lorenzo Corona, had confirmed the seizure carried out by the soldiers of the Fiamme Gialle. The defense of the twenty-six year old candidate had already raised the nullity of the documents that had led to the new evidentiary measure signed by the prosecutor Vincenzo Toscano and executed by the soldiers of the PEF unit of the Gdf of Avellino. The reasons will be filed in two weeks.
The interceptions
“I sent him a package… it wasn’t the questions from the competition for traffic policemen in Avellino, but rather questions downloaded from the internet and relating to a competition held in Brindisi for traffic policemen”. This is the version provided by the former mayor Gianluca Festa, during the interrogation before the investigating judge Giulio Argenio and immediately denied by further investigations by the police. The investigators ascertained the correspondence between the material received and photographed by the suspect DM (candidate in the competition for traffic policemen announced by the municipality of Avellino) on 13 December 2023 and that relating to the tests carried out the following day at Palazzo di Città.
