The three friends of the boys who took part in the violence that night were also convicted.
For the son of the former Livorno star Cristiano – present on the seventh floor of the Palace of Justice in Milan to be next to his son – and his friend Apolloni, the judge established a sentence of 3 years and 7 months contesting group sexual violence “by induction”. For the other three boys, the sentences range from 2 years and 5 months to 2 years and 8 months.
As regards compensation for damages, a provisional amount of 50 thousand euros has been established.
The Milan prosecutor Alessia Menegazzo had asked for five sentences of 3 years and 6 months. The abuse, according to the investigation conducted by the Flying Squad, occurred on the night between 26 and 27 March 2022 in Milan. Apolloni and Lucarelli jr were arrested and placed under house arrest in January 2023, and then, in June of the same year, they were released again.
The prosecution’s thesis was that the 22-year-old’s “state of alteration” that night was such as to render her “unconscious”, according to what emerged from the toxicological and psychological report filed by the pool of consultants appointed by the Prosecutor’s Office (Cattaneo-Candia- Brambilla-Rossetti).
According to the defense consultants, including a toxicologist and a psychologist, appointed by the lawyers Leonardo Cammarata and Francesca Nobili, the girl, however, was not in such a state of alteration as to be unconscious and incapable of expressing consent and indeed, her blood alcohol level was below 0.5, which allows you to drive.
The gang rape, according to the investigation, dates back to the night two years ago when the American student was allegedly approached by her two Livorno teammates and three other friends outside the “Il Gattopardo” nightclub. From that moment, according to the reconstruction, she would have been taken to Mattia Lucarelli’s apartment where the violence would have occurred. The file also contains images of videos of the abuse found on the boys’ phones.
