Brescia, former entrepreneur crushed by the crisis “freed” from debt

Brescia. A former entrepreneur resident in the province of Brescia, faced with a debt of around 250 thousand euros, having paid around 110 thousand, has definitively freed himself from the amount of residual debts (equal to around 140 thousand euros), thanks to a debt relief decree issued by the Court of Brescia.
Matteo Marini’s law firm follows the legal matter. The debt situation accumulated against him was mainly due to his participation as director of a company that carried out building construction, renovation and demolition activities.
The debtor’s inability to fulfill his obligations was due to the economic difficulties that arose following the negative performance of the construction company of which he was a member, following the crisis in the Italian construction sector that began in 2008.

In particular, in 2013 the company signed a works contract with a third-party company for a construction site that did not produce the desired results, due to the difficulties relating to the failure to realize the collections with consequent lack of revenue.
The situation had therefore become unsustainable for the debtor, That he started working as an employee of a transport company with a fixed salary but not sufficient to remedy the debt situation of the aforementioned company.
After 4 years from the decree opening the procedure, the time period in which the protagonist made his assets available to creditors (the property owned and a monthly liquid provision resulting from the difference between what is received on the pay slip and what is necessary for the support of the family) having been considered worthy as it has not contracted further debts and has not hindered the regular carrying out of the procedure, on the contrary , collaborated constructively with the bodies involved in the same, with a specific request formulated and filed at the Court of Brescia by the lawyer Marini, he was granted the benefit of debt relief.

This means that, as stated in the sentence issued on 23 April, the former entrepreneur, faced with a debt of approximately 250 thousand euros, having paid approximately 110 thousand euros in favor of the procedure (coming from the sale of the property and the monthly provision) he has definitively freed himself from the mass of debts and has obtained uncollectability from unsatisfied creditors of any credit.
The Court of Brescia ordered the debt relief of the subject, i.e. the definitive release from debts that remained partially unsatisfied towards creditors following the outcome of the assets liquidation procedure.
