Violent robbery in via Palestro: perpetrator convicted, accomplice acquitted

Around 4 am on July 28, 2022, a 57-year-old was on his way to work at the stationbut once you arrive in via Palestro had been surprised from behind by two young men, one of whom had grabbed his pouch over his shoulder and had snatched it from him, punching him in the face and causing him to fall to the ground. The man got up and chased the two, asking them to at least give back the mobile phone, but the criminals had threatened to hit him again and, after emptied the pouch of money, telephone and ATM cardthey had thrown him onto the street fleeing on foot.

The alarm was raised to the police by a security guard that while passing by car he had noticed a man on the ground. The victim, in a state of shock, was taken to hospital where he was diagnosed with a seven-day prognosis for the blows he received. The description he had provided to the police had allowed the alleged culprits to be traced: a 24 year old Italian resident in the province of Bresciabut has been living in the city for some time with relatives, with a police record against him, and an 18 year old Moroccan, who arrived in Italy that very day. The two boys had met that evening in a bar in the centre.

The clothes they were wearing during the robbery were found in their respective homes. Their photos had been shown to the victim who had them indicated with certainty. The ATM, however, had been thrown into a manhole in via Ghisleri.

Both ended up before the judge for a preliminary hearing on charges of aggravated robbery in competition. One of the two, identified as the material perpetrator was sentenced to 3 years and 6 monthsWhile for the alleged accomplice the magistrate issued a no-proceeding sentence.

Fundamental, in the procedure celebrated with the abbreviated procedure, are the images from the public and private cameras that had recorded the entire scene of the attack, as well as the faces of those involved and the clothes they were wearing. “My client”, explained the lawyer Andrea Daconto, lawyer of the acquitted young man, “did not participate in the robbery. From the images you can see that he was left behind”. In front of the judge there was also another boy, a 19 year old from the province of Brescia, accused of receiving the stolen mobile phone. Was acquitted: no evidence has emerged against him.
