After a year and a half the Salerno prosecutor’s office closes the circle around those responsible for the death of Alfonso Masito, the retired policeman who came to Ruggi due to a heart problem never diagnosed in the emergency room and died hours later while undergoing a CT scan. There are three people who prosecutor Gianpaolo Nuzzo has identified as responsible and for whom he requested and obtained the setting of a preliminary hearing which will be held in the coming weeks. They are two triagist nurses and an emergency room doctor. Identified in the victim’s relatives, who they relied onthe lawyer Agostino Allegro, the offended parties invited by the preliminary hearing judge Annamaria Ferraiolo to join as civil parties. All are charged with complicity to manslaughter.

THE ACCUSATION

According to deputy prosecutor Nuzzo, the three would have “violated the prudential rules” by contravening the guidelines developed for the specificity of the case “with independent negligent conduct and all having a concausal effect, causing the patient’s death due to acute transmutational myocardial infarction of the left ventricle”. In particular, the triagist who welcomed him upon his arrival on January 26, 2023 at 7.13 pm «did not proceed to carry out a complete anamnesis of the patient, limiting herself to reporting traumatic right-left shoulder pain with a pre-lipothymic episode in the triage form, without examining the characteristic or the duration of the pain, these symptoms which are typically connected to an ongoing heart attack and which everywhere should have immediately led to the assignment of a different code than the one given, green, thus determining a delay in the measurement of vital parameters”.

The first electrocardiogram, writes the prosecutor in the request for indictment, was carried out by the other triage nurse only thirty minutes later. According to the accusations made by the prosecutor’s office, the first triagist “did not proceed with reading the electrocardiogram and did not proceed with the re-evaluation of the patient’s assignment code”. All this despite the report reporting an anomaly due to hypertrophy or ischemia. In short, an immediate diagnosis of a heart attack would not have been made. The other triage nurse, a parametrist, also apparently failed to read the result of the electrocardiogram, so she did not inform her colleague.

The prosecutor also uses very strong words to indicate the behavior of the emergency room doctor (defining his conduct as negligent, reckless and imprudent). The doctor would have taken charge of the patient only at 3.31 am, eight hours after the triage (the green code, specifies the prosecutor, requires the visit within 120 minutes) «without even evaluating the outcome of the electrocardiogram tracing in the slightest , without re-evaluating the symptoms reported by the patient and his wife (whom he met only at 4 to obtain further anamnestic data) and which independently would have led to the serious cardiac crisis”. In this way, according to the prosecutor’s office, “wasting more time arranging analyzes (shoulder x-ray and brain CT scan which are totally inconsistent with the instrumental results already in her possession”.

HISTORY

The family members of the deceased man immediately filed the complaint with the police. The victim was of Sicilian origin, staying in Salerno with the wife of a relative. Masito had reached the hospital emergency room in his own car complaining of severe pain localized to his left shoulder, which had not been caused by any trauma, coughing and was also in a slight state of confusion. . He was undergoing a CT scan when his heart attack struck him. After the complaint the chief prosecutor of Salerno, Giuseppe Borrelli, delegated the investigations to the Flying Squad agents under the orders of the deputy commissioner Gianni Di Palma.
