“No corruption for the RSA Caposoprano”, the defense concluded: decision in July

Frost. The decision of the criminal panel of the court will arrive at the beginning of July. This morning, the defense concluded their interventions. Last February, the prosecutor’s office, through prosecutor Luigi Lo Valvo, asked for five convictions in the RSA Caposoprano affair. Three years and six months for the engineer Renato Mauro (at the top of the corporate structure and former manager and general director of the municipality) and for the former municipal councilor and FdI manager Sandra Bennici (in turn in the management structure of the Rsa). Three years for the ASP manager Luigia Drogo and finally two years and eight months for the other ASP manager Calogero Buttiglieri and for the former president of the city council and PD leader Giuseppe Fava. Only the corruption charge is still pending while all the other charges are covered by the statute of limitations. According to the prosecutor’s office, there would have been corrupt conduct linked to the accreditation of the healthcare facility. In the courtroom, the defense, during today’s hearing, instead presented diametrically different conclusions. The lawyer Rocco La Placa described Fava’s conduct as only institutional, with an interest in the fate of the RSA, exclusively linked to the city and the usefulness of a structure of that type in the local healthcare system. He underlined that the contacts were made with the ASP management not to press for the issuing of authorizations but exclusively to understand if there would be answers and if the process could be concluded, regardless of the outcome. He also ruled out any illicit conduct in the defense of the Asp Drogo manager, represented by the lawyer Davide Anzalone. It was explained that there was no gift in favor of her and furthermore the role of the accused could not have affected the regional accreditation. For the defence, no evidence has emerged to confirm any favors that the management of the SST (the company that controls the RSA) would have granted to the director of the provincial health authority. For the investigators, there would have been the gift of a basket of wines and a lunch in Caltanissetta. Circumstances which for the defender did not find concreteness during the hearing. Same conclusion for the alleged commitment to finding a job placement for the manager’s son. The lawyer Giacomo Ventura, in his conclusions, first of all dismissed the hypothesis of urban planning irregularities in the structure of the former Caposoprano hotel, later converted into an assisted healthcare residence. The defender actually highlighted the absence of sector regulations in the report of the prosecutor’s consultant. There would be no basis for alleged building abuses. The defense considered that the hypotheses of alleged ideological falsehoods did not exist with respect to the technical documentation of the process carried out on the structure of the former hotel. Once again, the hypothesis of corruption for the positions of Mauro and Bennici was rejected. There would have been no gifts to the ASP, Drogo and Buttiglieri managers, nor any further benefits that could lead to pressure for the issuing of authorisations.
