Veneto Council approves Pdl 238 of the Council on regional regulations on environmental matters

(Arv) Venice 21 May. 2024 – The Veneto Regional Council approved by majority, with 32 votes in favor and 9 against, the Regional Law Project no. 238 of the Council “Regional regulations on strategic environmental assessment (SEA), environmental impact assessment (EIA), environmental impact assessment (VINCA) and integrated environmental authorization (AIA)”.

During today’s session, the examination of the article was completed, including its amending part which, by summarizing the work and proposals received, aims to make the rules contained therein more effective.

We remember that the Second Commission, in which the PDL was based, had dismissed it, by majority vote, after having reworked its key aspects, no longer referring to the PNRR, but transforming it into a Framework Law on environmental matters.

The objective, in fact, is precisely to reform the regulations on environmental matters, with a view to simplification, making a regulatory adjustment, through the complete referral to the national legislative provisions implementing the community directives on SEA, EIA, VINCA and AIA (D .Lgs. 152 of 2006 and Presidential Decree 357 of 1997), with the simultaneous repeal of incompatible and/or outdated regional legislative provisions and the postponement, for the necessary implementation regulations, to subsequent regulation by the Regional Council.

In essence, a regulatory reorganization is carried out to eliminate inconsistencies and antinomies, with the repeal of regional provisions that conflict with, or are merely repetitive of, the state legislation regulating the matter. At the same time, we make use of the spaces of legislative competence attributed to the Region on the organizational and implementation level of state provisions.

During the debate and during the declaration of vote, the majority councilors defended the provision, underlining its opportunity and necessity, while the opposition complained that, in this way, choices are delegated to the regional council, which have a direct impact on the territories, which should instead remain in the hands of the Council.
