Over 500 irregular health workers seized by the Terni Customs and Monopolies Agency. The officials, upon physical verification of the goods, despite having ascertained conformity with the declared quantity, quality, origin and value, found that the labeling of a part of the shipment, i.e. 26 packages equal to 512 pieces between toilet and washbasins.
Despite the presence of the registered trademark, there were no precise and evident indications on the goods regarding their foreign origin or provenance. This could have misled the average consumer as to the correct origin of the products.
The company was therefore sanctioned for the misleading use of a registered trademark and for the irregularity in terms of the labeling methods in compliance with the provisions on the repression of false and fallacious indications of origin pursuant to art. 4, paragraph 49 bis, of Law 350/2003.
“Furthermore – the Adm informs – also taking into account the fact that the importer did not produce the declaration regarding the information that will be provided during the marketing phase on the actual foreign origin of the product, the officials proceeded with the administrative seizure of the consignment, pursuant to art. 13 of Law 689/1981, and sanctioned the company pursuant to art. 16 of the same Law, with the possibility of admitting it to the payment of the sum of 20 thousand euros. The documents have been sent to the competent Chamber of Commerce of Terni for information”.
