Another disciplinary case against a Carabinieri soldier who was unjustly sanctioned despite having correctly fulfilled his official duties. In essence, another Carabiniere who risked being left “alone” to bear the weight and mortification of a real injustice. This time the story was written differently. The Catania Provincial Secretariat of the Carabinieri SIM, to which the soldier was registered, stood alongside him with competence and professionalism to support him economically and technically, ensuring professional legal protection, as well as the necessary personal support.
The sanction arose following a disciplinary proceeding, for a supposed violation by the soldier of the provisions of the Lanzarote Convention regarding the hearing of a minor. The Marshal had therefore proposed an appeal through the hierarchy which had been rejected by the then Provincial Commander, making it necessary to appeal the aforementioned measures before the competent Judicial Authority. The TAR appealed, fully accepting the grounds of appeal, annulled both the decision rejecting the hierarchical appeal and the sanction imposed, deeming that the Marshal had operated in full compliance with the legislation and his duties. The Administrative Court also condemned the Administration to pay the legal costs. In this regard, the provincial secretary of SIM CC Catania Giampiero Tosto wanted to underline the result achieved by the Military Union, which has now consolidated itself as a solid national reality and therefore also in the Etna panorama. Specifically, the Provincial Secretary Tosto declared: “TARS – Catania has accepted a series of appeals drawn up by our affiliated lawyer, the lawyer. Christian Petrina, including the last one concerning the appeal of a disciplinary sanction imposed against one of our members by the previous Company Commander, for which the grounds of appeal were fully accepted. The legal protection that SIM offers to its members – continues Tosto – is the result of the constant commitment that SIM Carabinieri, through its General Secretary Antonello Serpi, places at the center of its project to guarantee and support the military community” The matter in question can only be a clear confirmation of how the trade union reality, now recognized in the military sector thanks to the intervention of the Constitutional Court in 2018, has filled a gap of which the military has suffered the consequences for too long and which today thanks to SIM Carabinieri and to the ever-increasing number of members it is instead a tangible and concrete reality.
