PORDENONE – A few hours after the first public appearance of Gianpaolo Zanotelthe announcement that the “new Pordenone” will take part in the next Promotion championship it’s already causing discussion. The reason? The club’s official supernumerary inclusion almost at the highest amateur level (above there is only Excellence). In the last few hours the noise generated through regional football social media and WhatsApp chats has become insistent. The controversies did not take long to develop: there are those who want the new Naonian association to be placed in the third categorya championship that will be reinstated in the 2024-25 season, “as a sign of respect for the rules – we read – and for those who fight for the survival of clubs in a difficult moment with the reform of sport”. The “riots” against a team that has yet to be born appear to be quite strong right in the city’s hinterland, where several companies already operate, Torre, Cordenonese 3S, Vallenoncello, Pordenone C5, Fontanafredda and Union Rorai above all. Some fans of these clubs, or at least who declare themselves as such behind the pseudonyms that populate the internet, are among the most vocal detractors of the project.

THE DETAILS

Regulation in hand, the case is complicated: there does not appear to be a precise rule to apply in such a situation. Gian Paolo Zanotel’s consortium represents a new company with a new registration number and an affiliation code different from that of Lovisa’s Pordenone Calcio. Article 13 paragraph 2 of the FIGC Statute, on the rules of play and championships, says that «The FIGC regulates the affiliation of the clubs and defines, in agreement with the Leagues concerned and after consulting the technical components, the rules of the tournaments . The FIGC establishes the criteria for formulating the rankings and approving the results; ratifies promotions and demotions; ensures the financial and organizational tools for carrying out sports justice and the refereeing function”. It is therefore the Football Federation that decides and, as a matter of practice, the clubs that have taken the place of failed or in any case disappeared associations are always started from the last categories. Practice, however, does not necessarily mean a rule of law to be applied. In this case it appears clear that, contrary to the jurisprudential dictate, it has become a source of law. By administrative practice we mean the «uniform conduct of some offices, produced following a process of standardization of administrative procedures, observed as deemed most suitable and appropriate, without however considering it dutiful and obligatory».

IN HISTORY

In Friuli Venezia Giulia, recently historic clubs such as Sacilese, Manzanese, Cormonese and Ufm Monfalcone have all started from the lowest category. In Italy, however, there are several examples of companies registered in excess in higher categories. This is the case of Atalanta and Juventus who have registered their U23 teams in C: in this case the club registration is the same, just as in Fvg it happened for Torre B in 2nd Category. The very term “piazza” represents an important element: a heritage of sporting passion and general interest must always be preserved by the institutions, see the cases of Reggina and Parma. On the other hand, Chievoverona (or Clivense) started again from the Third. In short, the rule doesn’t exist and practice says that the new Pordenone should start again (perhaps) from the Third. Something that the black-green people do not hope for.
