There is the signature on the pre-adoption of the act, now on to the forms of consultations for the definitive approval. The regional law on tourism is being addressed: the green light from the Tesei executive arrived on Wednesday. Reason? «The need to adapt the regulatory provisions to the evident and changed conditions of the tourism market, the result of in-depth reflections also carried out in concert with operators in the sector». Result? Repeal and complete replacement of regional law number 8 of 10 July 2017. News for the Municipalities.

The supervision and functions of the Municipalities

The first objective is to strengthen the planning, coordination and control role of the Region with a view to “effectiveness and efficiency of public administration action”. From a financial point of view there are no changes compared to the current regulatory system: from Perugia they speak of a streamlining of the financeable interventions as «the supervision and control activity, in fact never exercised by the Region, returns to the responsibility of the Municipalities responsible for the territory ». Among the formal innovations is the inclusion of the possibility of being able to carry out tourism promotion activities through the Region’s investee companies, in particular Sviluppumbria. Returning to the previous point, in article 4 it is now specified that the Municipalities are the holders of the technical-administrative competences in the field of accommodation facilities, organization activities, travel intermediation without the enabling qualification and supervisory functions: «With respect to the current legislation are transferred back to the Municipalities. In fact, the Region, by virtue of the transitional rule referred to in article 57, paragraph 2 bis of the current regional law on tourism, has never exercised these functions. The provision according to which the Municipalities can also act in association with each other is dictated not only by the needs of optimizing the use of resources, but also by the improvement of integrated management and the exchange of skills and best practices”. There is also the institutionalization of the ‘Umbria’ brand to promote the unitary image of the territory.

The areas and slow tourism

Article 11 regulates the so-called ‘tourism-relevant areas’ as «a further form of association envisaged for Municipalities in the exercise of functions in the field of tourism, compared to the current one of the special Unions of Municipalities; are consistent with the evolution of activities within the tourism system whose implementation by the Municipalities in associated form responds to the logic of subsidiarity, differentiation and adequacy”. Holiday houses and apartments

For holiday homes and apartments – also in light of national legislation – the possibility of carrying out this activity in a non-entrepreneurial form is eliminated. Guest house? Now the opportunity is given to serve breakfast to the guests in compliance with health and hygiene standards. Then there is space for open-air accommodation establishments: «An innovative element compared to existing legislation concerns the possibility of commercially using the additional name ‘glamping area’ if they offer overnight accommodation services in an alternative and innovative way in structures and furniture in a dedicated area» . Then there is the inclusion of the regulations for the areas equipped for temporary parking regarding the parking of caravans, motorhomes and similar vehicles, plus the accommodation of the pilgrim (not present in the current legislation): «Particular structure linked to the paths where hospitality can only be granted if all the conditions indicated are respected.” Signed by the regional director of the sector Luigi Rossetti and the tourism councilor Paola Agabiti.
