The 2-year sentence established by the Court of Appeal for Niko De Luca (lawyer Antonio Leone), 31 years old, from Benevento, on whom the Court, in September 2022, had inflicted 2 years and 6 months for attempted extortion, was partially annulled by the Supreme Court, aggravated injuries and private violence. De Luca had been called into question, like a 30-year-old, also sentenced, but to 1 year and 10 months, for an episode that occurred on January 12th two years ago, at the center of the Carabinieri investigation.
According to the reconstruction of the investigators, having arrived at the home of a woman in the Libertà district, they would have had the door opened by the unfortunate woman, threatening to take a knife or a gun. Objective: look for his companion, who had arrived after a few minutes. The two allegedly attacked him along the stairs leading to the apartment, punching him in the face and kicking him, even when he was now on the ground, to force him to hand over the sum of 2 thousand euros that the victim had withdrawn from his current account. . A sum that De Luca believed was his due by virtue of an agreement existing between them. Both would then have taken him in his car to reach his mother’s house, from which he should have asked to borrow the sum, but they had not found it.
Appearing before the investigating judge after the arrest, De Luca stated that they had argued because he wanted to know what had happened to the money that was used to pay three installments of a double loan. The starting point is the 600 euros credited monthly, as redundancy pay for De Luca, on a card linked to the man’s current account, on which two loans had been taken out in the interest of the 29-year-old, who repaid them after receiving the sums, in cash, on the other, a relative of his. He also added that he had reached his home after realizing that there was not the money he needed in his account, and that a heated argument had broken out between them.
The other suspect said he was a complete stranger, specifying that he had only accompanied De Luca, without being aware of the reason for the visit, and ruling out any aggression.
