He was acquitted, because he was incapable of understanding and will at the time of the facts, as ascertained by two expert reports during the investigation phase, the 39-year-old Amine Mohamed El Mirche, on 18 February last year at around 2.30 in the morning, had run over with his car, without braking at the Ghisolfa motorway barrier on the A4 Turin-Milan, the car with two women on board, Laura Amato, 54 years old, and Claudia Turconi, 59 years old, who died in the crash. The findings and the development of the investigations were carried out by the Novara traffic police. This was decided today in the abbreviated trial by the Milan magistrate Tommaso Perna, who ordered the safety measure in a Rems, given the social danger of the man. Measure which will be re-evaluated in two years and which will continue if it is still considered dangerous.

At the end of June 2023, the investigating judge Ileana Ramundo had ordered an additional psychiatric assessment, appointing the expert Marco Lagazzi, after a previous assessment, again decided by the judge and entrusted to the psychiatrist Raniero Rossetti, had revealed total mental defect. It was established in the report that the man suffers from a paranoid psychosis with “end of the world” crises. And the new psychiatric-forensic analyzes had essentially confirmed the results of the first assessment.

According to the expert opinion on the behavior of the 39-year-old – accused of road homicide and who was already subjected to security measures (first in a hospital and then in a community) in the investigation by prosecutor Paolo Filippini and the Novara traffic police – that night the psychotic disorder he has suffered from for years had an impact, not the hashish nor the benzodiazepines he had taken. Despite his already confirmed ailments, however, the 39-year-old still had a valid driving licence. He had also been declared incapable of understanding and will in the past in proceedings for robbery, injuries and private violence, but his driving license had not been taken away. The victims’ families, however, managed to obtain compensation from the car insurance.
