The FP CGIL Benevento, in accordance with the Regional Federation, having regard to the European Directive 2003/88/EC, the ruling of the Court of Cassation n. 19963 of 11 July 2023 and the order of the Court of Cassation, Labor Section no. 35146 of 15 December 2023 which established that “pursuant to art. 7 of the European Directive, as interpreted by the Court of Justice, a notion exists
European “salary” which includes any pecuniary amount that is connected to the execution of tasks and is related to the personal and professional status of the worker represents that, consequently to the above, the remuneration paid during holidays must not be lower than that paid during working days.
Therefore, it is requested to pay all workers, during holidays, the allowances related to the job, provided for by the applied CCNL while remaining available for a comparison for the regulation of any previous experience.
