The Guarantor of Persons Deprived of Personal Liberty of the Province of Brindisi, Dr. Valentina Farina, sent a letter to all the mayors of the province to shed light on the difficulties encountered regarding the obligations and skills of citizens in a state of detention (protocol registry office, marital status and recognition of natural children).
It is necessary to work to best respond and guarantee the effectiveness of Public Administrations:
1. delays in registering the legal capacity that is acquired at the birth certificate, effective as constituting the status of a child (on several occasions, prisoners do not have the possibility of recognizing their children within 10 days “LEGUAL OBLIGATION”);
2. events subordinate to the acquisition of documents relating to the registry (such as identity cards, access by minor children to the benefits of the maternity application, various consents and authorisations, registry registrations and cancellations).
The Guarantor promotes every initiative aimed at ensuring the provision of services relating to the right to health, education and professional training, but it is also necessary to ensure adequate and timely use of municipal registry and civil status services in favor of subjects subject to measures restrictive of individual freedom.
The Province of Brindisi, accepting Dr. Farina’s proposal, is considering implementing for the first time a Registry protocol, marital status and recognition of natural childrenwhich authorizes the civil status officials, delegated by the Area Managers, to go to the facilities that welcome citizens deprived of their personal freedom of the BRINDISI COURT HOME and the CAROVIGNO REMS, to produce the necessary documents.
The Guarantor of Persons Deprived of Personal Liberty of the Province of Brindisi is working on the study of the operational protocol which will be signed in the presence of all local administrators.
