He defended himself by claiming that he did not have sufficient income to guarantee the payment of maintenance of his ex-wife and two daughters Massimo Buscemiformer regional councilor of Forza Italia from 2000 to 2015 and several times councilor (twice elected in the province of Varese), and the judge of the Court of Busto Arsizio acquitted him because the fact did not constitute a crime.

According to the prosecution and the civil defender (Tiberio Massironi) the former regional councilor and former manager of Publitalia could have supported the expense as in 2013 he would have obtained over 480 thousand euros in liquidation by the Regional Council and would have had some real estate.
Defended by the lawyer Antonio Argento, Buscemi never took part in the hearings but filed a statement at the last hearing in which he explained the suffering he felt following the separation from the woman. In the end, judge Cristina Ceffa decided for acquittal, specifying that the statute of limitations had expired for the period 2015-2016.

We have only one certainty: a sentence from the civil enforcement judge who has already established a debt of 300 thousand euros towards his wife and daughters. If he had been destitute as he claimed in the trial he could have asked for a redetermination of the allowance but he has never done so in 9 years.”
