a crucial week begins

The week that opens promises to be decisive for the “Dolce Vita” investigation, with the Naples Review Court ready to evaluate the position of the three suspects subjected to precautionary measures. Tuesday will be the key moment, with the discussion of the appeal presented by the lawyer Marco Campora, defender of the former public works manager of the municipality of Avellino, Filomena Smiraglia, currently under house arrest since April 18th.

The defense will have the opportunity to contest the accusation, trying to demonstrate the unfoundedness of the accusations made against its client. However, at the moment, the hearings have not yet been scheduled for the other two suspects involved in the investigation into the contracts awarded to the municipality of Avellino: the architect Fabio Guerriero and the former mayor Gianluca Festa.

Guerriero is defended by lawyers Nicola Quatrano and Marino Capone, while Festa has Luigi Petrillo as his lawyer. It should be noted that Festa was the only one among the suspects to respond to the interrogation and that last Friday he saw the request for revocation of the precautionary measure to which he is subjected rejected by the investigating judge.

Last April 16th, again, the investigating judge of the Court of Avellino, Giulio Argenio, rejected the request for an evidentiary hearing presented by the lawyer Petrillo. The judge assessed that the need expressed by the defense – linked to the political role of the suspect – to limit copying operations only to data relevant to the investigations and relating to the contested period, can be satisfied directly by the prosecutor in cross-examination with the defence, without requiring the intervention of an expert appointed by the judge.

The dates on which the judicial police will proceed with forensic copies of all the material seized last March 6, following the searches by the Carabinieri of the Investigative Unit against the then mayor of Avellino, have been made known. The first was Canonical, on April 26th. On May 2nd it will be Fabio Guerriero’s turn. May 4th to Filomena Smiraglia. To conclude, then, on May 7th with the former tricolor band of the capital. It remains to be seen, therefore, how events will evolve in the coming days and what the consequences will be for those who are at the center of this delicate legal matter.
