Giovanni Di Leo remains prosecutor of Agrigento. The Lazio Regional Administrative Court rejected the appeal presented by the Sciacca prosecutor Roberta Buzzolani.
According to the Administrative Court, the CSM’s decision to appoint Di Leo “was based on a not illogical global judgement on the personality of the chosen one, in which his broad and more varied judicial experience was appreciated”.
“In fact, the CSM – writes the TAR in the justification of the provision – considered that the nominee has experience in both the civil sector and (largely) in the criminal sectorhaving carried out judging and prosecuting functions in first instance offices and at the Supreme Court of Cassation”.
The judges maintain that the CSM, instead of using the automatism according to which Buzzolani as prosecutor had more qualifications than her colleague, “with strengthened and entirely plausible motivation, he decided to enhance the varied previous activity of the other interested party, the diversity of degrees in which the latter has carried out the functions, together with the results achieved over the course of his long career”.
“The mere possession of a single specific indicator does not imply automatic prevalence over the other candidates – writes the TAR – because the CSM is free to carry out a more comprehensive and unitary assessment of the professional profile of the candidates with the aim of identifying the best manager in relation to the specific position put up for competition”.
