Uan act that created more than a few problems and now, eight months after approval by the city council (28 August), we are back to work. The Municipality of Terni is ready to update the commercial activity planning document (Dpac) with a series of new features: the consultation table is launched as required by regional law 10 of 2014 as part of the monitoring activity.

The inputs
In recent months there have already been those who have ‘slammed’ the Dpac for the establishment of new commercial activities. Now there is an update based on the guidelines of the Bandecchi executive which, in any case, will have to be submitted to the consultation table for observations. Which? There are quite a few: «Inclusion of the case study of free abandoned areas as a criterion for the application of exclusions for urban regeneration interventions revision of article 7 containing ‘rule for safeguarding approved plans or projects or initiated procedures’, also contemplating the case studies of urban recovery interventions in peripheral areas, the redevelopment and integration of the commercial settlement in industrial, artisanal and commercial areas; clarification on the scope of applicability of trade regulations, including programming, in relation to pharmacies that do not exclusively sell pharmaceutical products, medicinal specialties, medical devices and medical-surgical devices; clarification on the scope of applicability of the wholesale trade activity, referred to in article 30, paragraph 1, of regional law 10/2014, except as provided for in paragraph 2 of the same article and law; checks on the applicability and consistency between urban planning and commercial building regulations based on the results of the application of the document acquired to date; clarification of the cases of exclusion for the marketing of products in implementation of the sector legislation and checks on the applicability in cases of transfer of commercial activities regularly authorized by the authorization documents and in operation on the date of adoption of the Dpac in compliance with the qualitative and quantitative limits”.

There is therefore a mandate for the directors of Paolo Grigioni (economic development, the person responsible for the procedure) and Claudio Bedini (territorial planning and private construction) to prepare the modifications to the planning document with the directions of the council, as well as to start the phase of concertation and proceed with the strategic environmental assessment obligations. Then it will be up to the city council. There are approvals from Grigioni himself and from the financial activities manager Grazia Marcucci: «Since this is a policy act, the opinion is considered favorable – explains the first – for the procedural aspects regarding the review process, referring to the act of adoption of the document in CC the technical opinion of merit”. For the owner of the municipal budget, however, there are “potential indirect effects on the economic and financial situation of the institution for which it will be the responsibility of the proposing management to give full evidence of this in the subsequent acts to be adopted on this point”. She will talk about it again.
