In the wake of what has been done in previous years, the economic-financial police activities aimed at monitoring the correct fulfillment of the obligations envisaged by the anti-money laundering regulation by the obliged entities.
In particular, in the first months of this year, two different inspection activities were carried out by the local economic and financial police unit legal-accounting professionals (one with a studio in Viareggio and the other in Capannori), whose anti-money laundering safeguardsbased on the elements collected during previous judicial police investigations, appeared potentially unsuitable to satisfy the requirements required by the reference legislation.
Since the subsequent operational checks carried out in the field by the specialists of the unit made it possible to ascertain, in one case, the total absence of anti-money laundering protection and the consequent assessment of administrative violations in relation to 98 clients of the firmin the other two distinct forms of omission, including the failure to report suspicious transactions to the UIF.
These are offenses considered by the legislator to be rather insidious, which also provide for sanctions that can be imposed by the relevant authority for amounts of up to 50 thousand euros.
The purpose of the legislation in question is to allow the identification of risky situations, as outlined by the specific indicators of anomaly in the availability of the obliged subjects, then functional to the sending to the UIF of any reports of suspicious transactions connected to money laundering or terrorist financing reasons. In this context, the Corps’ action has the aim of verifying the good functioning of the anti-money laundering prevention system, concentrating resources towards the subjects and phenomena most at risk, where it is found greater vulnerability to the injection of illicit assets into the legal economy.
