Carpi, worker is fired: but the judge decides on her reinstatement – SulPanaro

CARPI – She had been fired from a clothing company in Carpi because, according to the company, the role of warehouse worker held by the woman had been eliminated and entrusted to an external company.

The worker, a 45-year-old from Carpi, had not expressed her willingness to be hired by the external company and the company – after 13 years – had decided to end the employment relationship.

As reported by the Gazzetta, judge Andrea Marangoni however annulled the company’s decision, establishing not only the reinstatement but also the “payment of social security and welfare contributions from the day of dismissal to the day of actual reinstatement”.

In fact, the worker, contrary to what was stated by the company, could have been employed in another job which, in reality, she already carried out. The woman actually also worked in the company’s shop, as did other employees. According to the judge, therefore, the woman “could also have been included in the cash register shifts, after a day of coaching”.

The judge then annulled the dismissal, reinstating the worker and applying the stronger protection of article 18 of the Workers’ Statute.
