Paolo Pate he is accused because – according to the accusation – he “provided his professional activity as an intermediary accountant, authorized to transmit to the Revenue Agency and the Companies Registry, two private deeds of transfers of limited liability company shares which took place between February and April 2018 ”. The decision to resign was made, Pate explained, also in light of “the political climate that has arisen in recent weeks”. The president of Amiu, therefore, took this decision – he explained – regardless of the fact that the investigation does not concern the role in the subsidiary and that the contested crime “is not contained in the list of the Pisa Charter, which should have committed me to tender my resignation in the event of indictment.” In this way, Pate continues, he wants to avoid “embarrassing the municipal administrations of Bari and Foggia”. Pate recalled, among other things, that the Prosecutor’s Office had requested that the case be dismissed. Pate reiterates that during the trial he will “finally have the opportunity to demonstrate that he was not involved in the conduct” contested by the magistrates.

The investigating judge Angela De Santis did not accept the request for acquittal and sent all the defendants to trial. With Pate there are Marco and Alceste Cavallarichildren of the former “King Midas” of the Bari nursing homes Franciswho died in Santo Domingo in 2021. The second of the two asked to be tried with rite abbreviated and its position will be discussed on June 4. Marco Cavallari was instead acquitted of the charge of impersonation “because the elements acquired do not allow us to formulate a reasonable prediction of conviction”, as can be read from the preliminary hearing judge’s ruling. The trial of Pate and the Cavalleri brothers will open on May 2.

The facts alleged against Pate and Cavallari date back to 2018, the investigations began after the complaint from Alceste’s ex-wife, Simona Zizzo Di Paolowho claimed to have been effectively excluded from srl Simafin and Cafin of which Alceste and Marco were sole directors respectively. According to the prosecution, the Cavallari brothers (to “achieve an unfair profit”, writes the prosecutor Marcellus Oak) would have formed “two distinct ‘private sales agreements between the parties of the share of the limited liability company'”. With the first, they would have “fictitiously shown that the partner” Zizzo Di Paolo “transferred for consideration 50% of her shares in Cafin srl” to Marco Cavallari, “without the knowledge and with the apocryphal signature of the same”, thus making him a partner 100% unique. With the second, however, they would have revealed the transfer by Marco to Alceste of 50% of the Simafin shares, “without the knowledge of the subsidiary” Zizzo Di Paolo “and falsely certifying the latter’s renunciation of the pre-emption rights provided by law”. Operations communicated to the public, the Revenue Agency and the Companies Registry by Pate, Simafin’s accountant at the time and Cafin consultant. During yesterday’s hearing, the consultant appointed by the court recognized Alceste Cavallari as the author of those false signatures. And it was Cavallari himself who admitted the fact during the previous hearing, issuing spontaneous statements.

Forza Italia and in particular commented on Pate’s indictment Mauro D’Attis, one of the parliamentarians who initiated the request for commissionership of the Municipality of Bari. “We are guaranteeists, therefore we do not comment on the indictment of the president of the Amiu who resigned today” says D’Attis before choosing today, day of the indictment, as a moment to remember “his political activism” as he defines it. “Last March 24 – recalls the Berlusconi parliamentarian – the now former president participated as a protagonist in the presentation of a list in support of the candidacy of Vito Leccese (the mayoral candidate of the Democratic Party, ed) together with the mayor of Bari Antonio Decaro. All this while the municipal companies in Bari are under scrutiny and one of them is placed under police investigation for mafia infiltration. This, for us, is serious and deserves further investigation.”
