Fine of 3.5 million to Meta for lack of transparency of Facebook and Ig

3.5 million fine for Metathe US multinational from Zuckeberg that controls the two mega social platforms Facebook and Instagram in which personal information of those who access it is also exchanged, often unconsciously. The fine was imposed by the Antitrust for unfair commercial practices and violation of articles 20, 21 and 22 of the Consumer Code.

Meta evaluates «possible actions» against the decision

In the meantime, however, he has decided to stop the behavior complained of. Consumer organizations appreciate the decision of the Competition and Market Authority, but with different nuances. Unc and Codacons see the glass half full, “the company has stopped the unfair practices”, while Aduc and Consumerismo point the finger at the “derisory” fine of 3.5 million euros which would only “tickle” Zuckeberg. The Antitrust – say the two organizations – thus has its weapons blunt, the fine has no deterrent function.

The disputed practices

Going into detail, there are two unfair practices contested. The first was carried out during the Instagram registration process when – says the Antitrust – “users have not received clear information on the collection and use of their data for commercial purposes». The second practice is the «account suspension» both on Instagram and on Facebook which would happen without «providing (the user) useful communications for any disputes» – in these cases one can turn to an arbitrator or a judge – and what is more, too short a deadline is foreseen (30 days) to oppose the suspension. We disagree with the decision taken by the AGCM and are evaluating the possible actions to take”, replied a Meta spokesperson.
