Anac has updated the reference prices regarding the healthcare sector

Anac has updated the reference prices in the healthcare sector for catering services, following the inflationary dynamics recorded.
Compared to data published in February 2022, the reference price of the catering service it was revalued by 3.18%. In line with the provisions of the technical document attached to Resolution no. 1204/2016, the update was carried out on the basis of the Istat price index “NIC class ECOICOP 11.1.2 Canteens” (published by Istat in May and reported in April).

THE reference prices in the healthcare sector published by the Authority are used for planning the contractual activity of the public administration and constitute the maximum award price based on the provisions of Legislative Decree 98/2011). Furthermore, if “significant differences in unit prices emerge, the Health Authorities are required to propose to suppliers a renegotiation of the contracts which has the effect of bringing the unit supply prices back to the reference prices as identified above, and without this entailing modification of the duration of the contract. In the event of failure to reach an agreement, within thirty days of the transmission of the proposal, regarding the prices as proposed above, the healthcare companies have the right to withdraw from the contract without any cost to them, and this in derogation of the article 1671 of the civil code. For the purposes of this letter, significant price differences mean differences greater than 20% compared to the reference price”.

The identification of reference prices on the part of Anac favors the market transparency and supervision, allowing public operators to know whether the agreed price is optimal or not; it also represents a tool for verifying the work of contracting authorities. For this reason i reference prices they are able to activate a virtuous process of cross-checking between the various actors in the field, which becomes an effective tool for preventing corruption and fraudulent phenomena, but also inefficient behaviour.
Setting reference prices then constitutes effective help to public administrations, facilitating the preparation of specifications, as the threshold to be used as the basis for the tender is indicated. And it guarantees savings which, on a large scale, are substantial.
