Municipalities ask for urgent action on speed camera approval

ANCI and UPI, i.e. the associations representing the Italian Municipalities and Provinces, are calling for a urgent intervention by the Government on the question ofapproval of speed cameraswhich exploded a few weeks after the ruling of the Court of Cassation which effectively sanctioned the nullity of fines for speeding detected with electronic devices if the latter are only approved and not even approved. A big problem considering that in practice no speed camera installed in Italy is approved. Municipalities and Provinces ask for a quick clarification both to avoid a rain of appeals (in Pordenone they decided to turn them off for this very reason) and to safeguard road safety.

ANCI: THE SPEED CAMERA SITUATION CREATES UNCERTAINTY AND REASONS FOR LITIGATION

He spoke on behalf of the ANCI Marco GranelliCouncilor for Safety and Civil Protection of the Municipality of Milan, who during a hearing in the Environment Commission of the Senate as part of the examination of the bill on the reform of the Highway Code, hoped for the immediate resolution of the age-old problem from the approval of speed cameras, linked according to him to the failure by the MIT to issue a specific regulation for the approval of automatic speed control devices. “This situation“, explained Granelli, “is creating uncertainty and reasons for litigation, especially following the recent ruling of the Supreme Court, which notes that speed cameras must be approved in any case. We know that the ministry had proposed an amendment contained in the bill of the new Highway Code, which however the Chamber rejected at first reading. As Anci, we ask that the rule proposed by the ministry itself be reinstated, or that the regulations be quickly issued useful directives for approving speed cameras“.

UPI: SPEED CAMERA AND TUTORS FUNDAMENTAL FOR ROAD SAFETY, MAKING CLARITY

The UPI representative is on the same line Andrea Massaripresident of the Province of Parma, who recalled how the provinces manage over 100 thousand km of roads: “Precisely for this reason we ask for maximum attention to the relevant measures to speed cameras and tutors which, in a condition of serious shortage of local police personnel, are the only effective tool for ensure greater safety on the roads and reduce the level of accidents. We need to quickly clarify the legislation in order to allow full use of the devices, or a very serious blow will be dealt to road safety“.

MUNICIPALITIES ALSO REQUEST CHANGES ON BLUE STRIPES AND CYCLE LANES

Before the Senate Environment Commission, Granelli also raised the problem of the regulation of parking in urban areas and cycle lanes, asking on behalf of the Italian Municipalities to make changes to the text of the new CdS. “On cycle paths“, said the councilor, “the text of the new code abolished some rules in force since 2020 which had allowed the Municipalities to implement hundreds of kilometers of cycle lanes also in signage. All this had allowed us to make available a better protection compared to the total absence of protected routes, to be improved later with structural interventions. Hence ANCI’s request to leave the rules unchanged, safeguarding the investments made in recent years, also with the use of ministerial resources. Instead on the topic of regulated parkingthe Municipalities consider the announced direct intervention on traffic to be a matter foreign to the Highway Code, as well as difficult to implement. rates. On the contrary, we believe it is more appropriate to provide national guidelines that are homogeneous but at the same time respect the autonomy and specificity of individual municipalities“.
