For the construction of padel courts are needed specific permissions. In fact, it is not free construction, i.e. an intervention that can be carried out freely. The Court of Cassation recently explained why, also indicating what procedures to follow. Please note that the free building glossary – which includes maintenance work on the apartments, including on the outside of the building and in the garden, which can be carried out without the need to submit any type of communication to the Municipality – has come into force on April 22, 2018.
With sentence 11999/2024, the Supreme Court clarified that the construction of padel courts represents “an intervention which, due to its overall characteristics, i.e. the installation on a surface functional to the particular sporting activity, due to the necessary carpentry works and the presence of perimeter glass sheets, modifies the territory and is therefore classified as an intervention of new construction”. From the moment the construction of padel courts constitutes a new construction project requires the permission to build.
According to what was later explained by the Court of Cassation, for the construction of padel courts The permission to build it is required both for construction activities and for all interventions that imply a permanent modification of the soil and its use for purposes other than those that fall within the natural condition.
Ruling 11999/2024 of the Cassation follows ruling 223/2023 of the Piedmont Regional Administrative Court, which explained that the construction of padel courts transforms the territory and always requires the permission to build; in restricted areas, in addition to the building permit, authorization from the authority responsible for protecting the restriction is also required.
